Roundup Investigation

A class action is where one person (the lead Plaintiff) brings a claim on behalf of a group of people who are all affected by the same issue, in this case the exposure to the chemicals in Roundup. The lead plaintiff represents everyone else who are referred to as group members.

As the case is run by one person, they represent all others in the group. This means that once the lead Plaintiff proves that the Defendant, in this case Monsanto is liable to pay damages or compensation then everyone in the group is then eligible to make a claim and they only then need to prove exposure to the chemicals and the effect of the exposure.

The benefit of a class action is that the one person, the lead Plaintiff takes on the risk of running the case on behalf of all group members when the Court decides the main issues that involve all the class called the common issues. If the lead Plaintiff was not successful in the case then group members would not be asked to pay any money.

LHD also runs the case on the basis that if we do not obtain compensation then you do not owe us any legal fees.
